MITAMERU Terms of Use

1. Definitions

• "Service": the MITAMERU app, the website (mitameru.com) and related services we provide.
• "User": anyone who uses the Service.
• "Registered User": a User who has registered under Section 4.
• "Records": logs a Registered User adds to the Service (exercise, condition, meals, weight, body fat, comments, photos and so on), scan still frames, the 3D models and outlines the Service creates, goals and other information.
• "Friends": other Registered Users connected through an invitation.
• "Pro": the paid plan of the Service.
• "Store Providers": Apple Inc., which operates the App Store, and Google LLC, which operates Google Play, and their affiliates.

2. Agreement and age requirement

• By using the Service, you agree to these Terms.
• The Service is for people aged 18 and over. Anyone under 18 may not use it.
• If you register with a false age, we may cancel your registration without notice.

3. Changes to these Terms

• We may change these Terms where the change is in the general interest of Users, or is reasonable in light of its necessity and content, in accordance with the Civil Code of Japan.
• We will announce the change and its effective date on this page and in the Service before it takes effect.
• If you use the Service after the effective date, you are deemed to have agreed to the changed Terms.

4. Registration

• To use the Service, sign in with your Apple or Google account and follow our registration steps.
• We may refuse a registration, without giving reasons, if the information is false or incomplete, the applicant is under 18, the applicant has violated these Terms before, or we otherwise consider it inappropriate.

5. Your account

• You are responsible for managing your account, including the Apple or Google account you sign in with.
• We treat any action taken with your account as taken by you.
• If you notice unauthorized use of your account, contact us right away and follow our instructions.

6. Nature of the Service

• The Service is for recording and comparing changes in how your body looks. It is not a medical device and is not intended to diagnose, treat or prevent any disease.
• The 3D models, outlines, charts and numbers it shows are estimates that may differ from reality depending on capture conditions. We do not guarantee their accuracy.
• Exercise, diet, cutting and bulking are your own decision and responsibility. If you have health concerns or feel unwell, stop and consult a doctor or other professional.
• The Service does not encourage rapid weight loss or goals that harm your health.

7. Capture and photos

• Scans and log photos may only show your own body. Do not capture or add photos of anyone else.
• Scan still frames are sent encrypted only to build your 3D model and are deleted from our servers right after the model is made.
• Photos you add to your daily log (Pro) are visible only to you and are never shared with Friends.

8. Friends

• Connecting with Friends requires an invitation and acceptance. You choose what each Friend can see. Weight, body fat, comments, photos and 3D models are never shared with Friends.
• Do not publish or repost information you see from Friends, or cheers you receive, without their consent.
• Disputes between Friends are to be resolved between the people involved.

9. Pro (paid plan)

• Pro is an auto-renewing monthly subscription of ¥480 (tax included in Japan; local prices vary) offered through the App Store or Google Play. What Pro includes (number of scans, log photos, Friends and so on) is shown in the Service.
• Payment is charged to your Store Provider account at confirmation of purchase, and the subscription renews and is charged automatically every month until you cancel.
• You can cancel at any time in your App Store or Google Play subscription settings. On the App Store, the subscription renews unless canceled at least 24 hours before the renewal date. After canceling, you can use Pro until the end of the period you paid for.
• There are no prorated refunds for canceling mid-period. Refunds follow each Store Provider’s policies; we cannot refund purchases made through a Store Provider directly.
• Deleting your account does not cancel your subscription. Cancel it in the store first.
• We may change the price or contents of Pro. We will announce price increases at least 30 days before they take effect and follow the Store Providers’ procedures.
• Your Records remain after Pro ends. You can no longer add things beyond the free plan’s limits (such as photos or Friends).

10. Personal information

We handle personal information according to the MITAMERU Privacy Policy.

11. Prohibited conduct

When using the Service, you must not:

• Violate laws or public order, or engage in criminal activity
• Capture or add another person’s body or face without their consent
• Infringe the intellectual property, publicity, privacy or other rights of us, other Users or third parties
• Harass, defame, threaten, discriminate against or impersonate others
• Add obscene, violent or otherwise inappropriate images
• Place excessive load on, gain unauthorized access to, or interfere with our servers or networks
• Reverse engineer, modify or copy the Service
• Use multiple accounts, or transfer or lend your account to anyone
• Use the Service for commercial purposes without our permission
• Collect or store other Users’ information
• Use the Service if you are under 18
• Anything else we reasonably consider inappropriate

12. Rights

• Intellectual property rights in the Service belong to us or our licensors.
• You own your Records. You grant us a free license to use your Records as needed to provide the Service (storing them, creating 3D models and outlines, showing them to you and the Friends you choose, and creating share cards when you choose to).
• We never publish your Records without your consent. Only if you turn on "Help improve accuracy" in Settings may we use them, without photos and in a form that does not identify you, to improve the accuracy of 3D models.

13. Changes, suspension and termination of the Service

• We may change the Service or suspend it temporarily without notice (for maintenance, outages, natural disasters and so on).
• We may end the Service. If we do, we will give reasonable advance notice.

14. Suspension and removal

If you violate these Terms, or if we consider it necessary, we may suspend your use of the Service or remove your registration without notice. We are not liable for any resulting damage.

15. Leaving the Service

You can delete your account at any time in the app under Settings › Export or delete data. All your Records are deleted and cannot be restored. Cancel any Pro subscription separately in the store.

16. Disclaimer

• We do not guarantee that the Service fits your particular purpose, has the effect or accuracy you expect, or is free of defects.
• We are not liable for damage arising from your use of the Service, except in cases of our intent or gross negligence.
• Where we are liable under the Consumer Contract Act of Japan or otherwise, except in cases of our intent or gross negligence, our liability is limited to the amount you paid for Pro in the month the damage occurred, and excludes damage arising from special circumstances.
• We are not liable for disputes between Users, or between Users and third parties.

17. No assignment

You may not assign or pledge your position, rights or obligations under these Terms without our written consent. If we transfer the business of the Service, we may transfer our position, rights and obligations under these Terms and your information to the transferee, and you agree to this.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect.

19. Contact and notices

Contact us at mitameru@hoshikaru.com. We give notices to Users in the Service, on this page, or by other means we consider appropriate.

20. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo Summary Court or the Tokyo District Court has exclusive jurisdiction in the first instance over disputes about the Service.
